Mom shoots intruder....the right thing?

Mom who shot intruder inspires gun control foes

LOGANVILLE, Ga. (AP) — A Georgia mother who shot an intruder at her home has become a small part of the roaring gun control debate, with some firearms enthusiasts touting her as a textbook example of responsible gun ownership.
Melinda Herman grabbed a handgun and hid in a crawl space with her two children when a man broke in last week and approached the family at their home northeast of Atlanta, police said. Herman called her husband on the phone, and with him reminding her of the lessons she recently learned at a shooting range, Herman opened fire, seriously wounding the burglary suspect.
The National Rifle Association tweeted a link to a news story about the shooting, and support poured in from others online, hailing Herman as a hero. The local sheriff said he was proud of the way she handled the situation.
"This lady decided that she wasn't going to be a victim, and I think everyone else looks at this and hopes they have the courage to do what she done," Walton County Sheriff Joe Chapman said Wednesday.
Herman was working from home Friday when she saw a man walk up to the front door. She told police he rang the doorbell twice and then over and over again. He went back to his SUV, got something out and walked back toward the house, a police report said.
Herman took her 9-year-old son and daughter into an upstairs bedroom and locked the door. They went into bathroom and she locked that door, too. She got her handgun from a safe, the report said, and hid with her children. At some point, she called her husband, who kept her on the line and called 911 on another line.
In a 10-minute 911 recording released by the Walton County Sheriff's Office, Donnie Herman calmly explained what was happening to a dispatcher. His part of the conversation with his wife was also recorded.
"Is he in the house, Melinda? Are you sure? How do you know? You can hear him in the house?" Donnie Herman said.
His wife told him the intruder was coming closer.
"He's in the bedroom? Shh, shh, relax. Just remember everything that I showed you, everything that I taught you, all right?" Donnie Herman told his wife, explaining later to the dispatcher that he had recently taken her to a gun range.
It wasn't clear from the recording exactly when they went to range and Donnie Herman told The Associated Press on Wednesday the family didn't want to talk about the shooting.
After Donnie Herman told his wife police were on the way, he started shouting: "She shot him. She's shootin' him. She's shootin' him. She's shootin' him. She's shootin' him."
"OK," the dispatcher responded.
"Shoot him again! Shoot him!" Donnie Herman yelled. He told the dispatcher he heard a lot of screaming, but he seems to get increasingly worried when he doesn't hear anything from his wife.
Melinda Herman told police she started shooting the man when he opened the door to the crawl space. The man pleaded with her to stop, but she kept firing until she had emptied her rounds, she told police. She then fled to a neighbor's house with her children.
The man drove away in his SUV. Police found the SUV on another subdivision street and discovered a man bleeding from his face and body in a nearby wooded area. Police identified the suspect as 32-year-old Paul Slater of Atlanta.
Chapman said the hospital asked him not to comment on Slater's condition, but he said he is not certain Slater will survive. Authorities have a warrant but haven't formally arrested Slater yet. They plan to charge him with burglary, possession of tools for the commission of a crime and aggravated assault, Walton County sheriff's Capt. Greg Hall said.
A phone number for Slater was not listed and it was not clear whether he has an attorney.
Authorities believe Slater targeted a home in another local subdivision but left when confronted by the homeowner, Chapman said."

Z:  So, did she do the right thing?    "Shoot him! Shoot him!"  sounds awful to me...just awful.  But here's a husband and father whose whole world  is in a crawl space and an intruder's pushed himself in..........who knows what he might have done?  This wasn't a burglary;  he didn't just take stuff and run, he went down into the crawl space;  what was she to think?   They might have all died.........but, instead, the burglar may die, according to the reports.  He was shot many times and at pretty close range.

What if she had not had protection?    Is it okay to consider HER AND HER FAMILY?  Or do we go into "People shouldn't have guns.........it's dangerous.   Ban all guns because people get hurt."?   Don't this wife and her children matter?

What do you think?

I wonder how many who will comment to this post have ever been threatened by a robber or a burglar with a gun.

I have. Let me tell you that such a thing is a terrifying experience.

I also wonder how many people who will comment to this post have ever had to cringe in fear in their own home when an intruder entered?

I have. Again, such a thing is a terrifying experience.

When one is faced with such situations, the police cannot arrive quickly enough!

So, I don't blame the husband or wife for what happened in the incident related in this blog post.

Always On Watch said...

BTW, when I mention "a terrifying experience," I not only mean terrifying for those moments. The after effects of such events remain with a person for a long, long time.

Yes, I know. I've been there.

Anyone who enters someone else's house uninvited should EXPECT to be SHOT DEAD.

PERIOD!

JonBerg said...

"So, did she do the right thing?"

1) The potential victims are alive and safe.

2) The perpetrator is in custody.

3) A message has been sent to other, possible, peretrators.

With all due respect, I don't understand the question.

David said...

The right thing to do, the ONLY thing to do, was for that mother to defend herself and her children any way she could. Having a gun was the ONLY thing that would put her on even or greater footing than someone much larger and physically stronger than her who potentially means her and her family harm. I simply cannot fathom the mindset of anyone who would deny her the right of defending herself and her children.

Bob said...

It seems pretty clear that if the woman would have answered her door, the thief would have gone away. It happened earlier with the same guy.

However, the victims had no idea that the man would avoid confrontation. I don't believe you can ever make that assumption.

The lady did the right thing for herself and her children. The lady's husband did the right thing by preparing her for such eventuality.

There are lots of people that will say that she should have just let the guy have anything he wanted. Suffice it to say that it wasn't any of them in the confrontation, it was a vulnerable young mother with her children, and she rightly perceived that she was at risk.

This should help end some confusion over those nasty "assault" weapons.

FROM Z OF GEEEZ AT WORK:

AOW..the TERROR of it is what most of us simply don't understand 1000%. It is also what people need to consider when a policeman shoots someone and the public says he was so wrong. We don't know the circumstances but thinking people know that TERROR of being shot is not reserved for civilians. Cops have families, too.
The woman who shot was protecting her CHILDREN, too...you are so right to remind us of the real emotion of this incidence.

FT..you have an excellent point. Here's the problem; your rhetoric will now be scorned by leftwingers who simply don't GET IT. It sounds AWFUL to say SOMEONE SHOULD BE SHOT DEAD but MY POINT for posting this story is SHE AND HER CHILDREN MIGHT VERY WELL HAVE BEEN KILLED....why is that NOT SO IMPORTANT to anti-gun nuts?

JB....questions are what's kept my posts hopping with excellent comments.. That's why I do it. You're right; the answer should be so obvious but it IS NOT to many.

David..welcome to GeeeZ and "ME TOO!" on your comment.

Bob...well said.

Imp...no time now, but I thank you for posting a link and will see it tonight. xx

@Z

"why is that NOT SO IMPORTANT to anti-gun nuts?"

Cause they refuse to believe that one needs to protect themselves.....cops are not compelled or obligated to protect you.

Then they always make these asinine arguments...couldn't they have wounded him? Couldn't they have just shot them in the arm or the leg???

Ask a cop how he's trained to shoot....at the mass...period.

Anonymous said...

From GeeeZ:

Sorry, Imp...I'm one of those who does feel that shooting at a leg or arm is probably the first goal.
But, you have to be truly trained to be able to shoot like that.
That's why people are saying those who aren't trained aren't so good with a small handgun. If your aim isn't too hot, don't bother to have one.

But, ya....I'd probably shoot for the chest if I was scared witless at something coming at me...but I'd hope that those who know how to shoot would not aim for the head or chest if they could help it.

JonBerg said...

I don't mean to sound obtrusive but what about the argument concerning the non-fatally 'wounded' perpetrator having the right to civil action against his/her would-be victim? I'm just asking.

AOW, I don't personally think it makes much difference here but the article does not state the intruder was armed.

At any rate, the NRA never prints the articles telling of gun loon daddy getting laid off, coming home and blowing away the wife and kids.

Guns in homes get used more often against people you know.
But make your own choices. No one is coming after your pop guns. Just don't blow away the family.

From GeeeeZ:

JB...good point; there are suits brought. Imagine someone breaking into your HOUSE and then suing because you tried to protect yourself from him BREAKING INTO YOUR HOUSE?

Ducky, the NRA didn't print this, either. I hope you'll wait to check if someone's armed when you're a mother with two children and the intruder IS entering the crawl space in which you're hiding...which is what happened.
Sure, cooler heads could prevail but I'm thinking not too many people are cool heads faced with death or any kind; someone broke into her house. Think he was there to have a cup of coffee?

Thersites said...

She would have needed less rounds with a bigger gun.

Fewer rounds, Thersites, fewer. I'm surprised at you for making such an egregious syntactical error. ;-)

However, your point is well taken.

Waylon said...

..." the NRA never prints the articles telling of gun loon daddy getting laid off, coming home and blowing away the wife and kids."

But the New York Times, Boston Globe and Washington Post would. Did I forget to mention Piers Morgan would?

No point is ever too obvious for you to miss completely, Ducky.

FreeThinke said...

Z, of course it sounds horrible to say someone should be shot dead, but it's far MORE horrible that anyone would even IMAGINE it could be "improper" to do just that when he, she or it feels he, she or it is threatened.

I feel -- very strongly -- that allowing ourselves to intimidated -- or even in any INFLUENCED -- by the left is dead wrong.

These people would never under any circumstances give any of US a break, so I advocate being as clear, direct, uncompromising -- and inconsiderate -- in stating "our" position as they are in pushing their rotten, ill-conceived, pseudo-idealistic, always tyrannical agenda.

And no matter how polite, considerate, temperate and fair-minded you may be when addressing leftists in their lairs, most of them will ALWAYS find a way to twist your words or take some remark out of context to show you in a bad light, so I say "To hell with them!" ;-)

Seriously, no one should ever feel apologetic about telling the TRUTH -- no matter how harsh, unflattering and inflammatory it may be.

At least thats the way I feel about it. What's right for me, may not be for others, I freely admit.

I have had a gun pulled on me when I was unarmed. It was terrifying!

Even though the gun-wielder did not fire and did not rob me, I literally trembled for over an hour after the event was over.

Liberal gun control imbiciles think she should have surrendered her children to the intruder, and then allowed herself to be done with as the intruder wished.

After all, her husband had called 911, and that's all that should have been done.

I say, "Good on her!!"

Pris said...

Good grief, of course she did the right thing! Why would a stranger seek out someone in a crawl space? To do what, to say have a nice day?

Ducky, get real! What would you do, wait and see if he pulls a gun on you? He's a stranger who broke into her house!!

Imagine if you can, being terrified, and protecting your children.

I'd do anything to protect mine. Of course you can't relate because you don't have kids.

This wasn't a movie, it was real, and one doesn't have the need to wait and see what this man would do. By then, if she did, it would have been too late.

I think I'll tattoo the word "Dumbass" on the forehead of the next intruder who breaks into my home! Try and stop me, Feinstein!

Brooke said...

ABSOLUTELY she did the right thing! And if she completely discharged her weapon into the intruder, she still did the correct thing. Most police departments no longer teach tac-tac-assess, they teach fire until the threat is neutralized!

And as for leftists like Ducky who get SOOO sympathetic for the perp, I would submit that had he not been in the commission of a felony he would not have been in the position to get himself shot.

Who cares if the intruder was unarmed. He is a full-grown man, and quite capable of inflicting deadly harm on a woman with his bare hands! And, should someone illegally enter my home, I would assume they mean to harm me! That person certainly isn't there to serve me tea and crumpets!

Also, I would use whatever means at my disposal to prevent an intruder from even possibly harming my children, just as this momma bear did!

The lady should be hailed as a hero.

Brooke said...

Pris has an excellent point, too. If he just wanted to do a grab and run robbery, he'd have done it. I sat on a Grand Jury and saw several of those. The perp fled when he realized he was about to be confronted.

This guy was a bad dude, that though he had an easy victim. Thankfully, he did not.

Let's say we have the mind of libtard and think ALL guns can be removed from America and None can get in.

What happens when a little gang of thugs shows up to rape and pillage at your house? What would the average persons do to protect themselves? Very little in 99.99999999999% of the cases.

The new majority in America can't even think this far ahead.
We have a voting majority of birdbrained morons being led by racist, anti-American imbeciles.

What's horrible is that the left extrapolates, from "he deserves to be shot," to that whoever said that is a killer, hates people, and has no heart with no consideration given to the fact that a family could have died instead!. THAT's the stupidity and REALLY horrible thing of the left.

Kid, good one!

EVERYBODY...that's my point as I said above...this guy was entering a CRAWL SPACE...was it to say HELLO?
what's hard about that to understand? To imagine that the next step is hurting her family?

Sorry...but that dog won't hunt...not with all that fear and adrenaline rushing through you.

Let's take the cops...NY City...6 cops show up....fire 60 rounds...reload...and hit the perp once.

And these are so called "trained" to use guns? BS...most cops have to use the range once a year. I know civilians that go twice a month to their local ranges and clubs.

Now the cops want hi capacity mags....then I should have them too. And if they're such good shots.,..they can limit themselves to the standard capacities too. 15 or 16 + 1.

David said...

Also, as far as deliberately targeting the leg or arm goes, that can have seriously negative legal consequences. The law allows deadly force in a self-defense situation to STOP an attacker, even to the point of killing them. But if you were to deliberately target an arm or leg, a defense lawyer could say you were trying to MAIM the attacker instead of STOPPING him/her and that's another whole legal kettle of fish. Morally it sounds better to avoid killing another person, but you're on much better legal ground if you can honestly claim you were trying to STOP them from attacking.

Anonymous said...

@david..

Bravo. I concur.

Kid said...

David. Yep. Also in CCW here in Ohio, they tell you that a lawyer is going to follow every bullet out of your gun.

If you shoot and don't kill, you could end up being sued by the perp who can come up with some outrageous story. "I was sleep walking, I was frantic to get to a phone and call for medical help, thought I was having a heart attack..."

In Ohio, they have a retreat law, so technically, you are supposed to attempt to retreat before using deadly force. Therefore, if you don't use deadly force, they could argue you didn't really have to shoot.

The instructors advice is to say "I believed my life was in danger" and that's it. And personally I wouldn't shoot someone unless I did think my life was in danger, so that also cancels out legs and arms.

I'm going for a couple in center mass, and one or more in the head in case of body armor.

Z said...

David, that sounds absolutely nuts, if you don't mind my saying so! :-)
You KILL someone and they could say it was homicide.
You maim someone you're not in quite as big trouble legally, right?

Kid said...

Z, the key phrase for me in this is I wouldn't shoot someone unless I believed my life, or a family member's life was in danger. Who would want to.

viburnum said...

She positively did the right thing to protect herself and her children. She had already retreated as far as she could go.

It's an absolute disgrace that she's been described in some quarters as 'trigger happy".

Z said...

viburnum, "trigger happy", imagine? that is NUTS.

Kid, I see your point. Why would anybody shoot, let alone kill, unless he was sure he was going to die instead?
I think with cops, and I'm a wild supporter of the police, there are times when a perp's running away and shooting in the leg could stop him...from hurting someone else, hurting himself, etc.

I don't know: i supposed it's a 'case by case' and I hope never to have to experience anything close to shooting anybody.

Kid said...

Z, Me neither.

But yea, guy running away? I'm not going to shoot at all. I call the cops and say he went that'a way.

The most confusing thing for most people would be the guy who is in your house, doesn't appear to have a gun but keeps coming at you. Is he on PCP and going to take you gun and shoot you?

If I have time, I put one in the floor, tell him to stop, if he keeps coming he made a fatal mistake.

Anyway, Last thing I want to have to do.

JonBerg said...

Thanks Folks,

I just made sure that the .380 in my Computer Desk is still ready. It is! One less in the magazine assures no spring problem and one in the chamber assures immediate results! That's my 'little' one!

David said...

Z, I know it sounds counterintuitive, but that's how the law works. If you only shot to wound, legally it can be said you weren't afraid for your life, therefore it wasn't necessary to shoot at all. I don't fully follow the logic myself, but that's how the law sees it. Besides, in a situation where you have to shoot somebody, a limb is not a very big target and there's a good chance it won't stop an attacker, especially if they've got a gun themselves. Remember, this guy took five bullets to the neck and torso area and still was able to drive away before succumbing to shock, he may well have been able to shrug off a leg or arm injury and still be able to fight back, and this story may not have ended so well. Center mass is the best target and the way to go.

JonBerg said...

What if she had a larger capacity of ammo? Too bad a .38 has only 6 rounds.
I love revolvers for their dependability but more shots could have done a better job. Sorry I don't have my PC hat on tonight!

When one's space is invaded, the victim cannot always ascertained whether or not an intruder is armed. Furthermore, a male can often easily overcome a woman or child by physical force.

Another piece of clear and convincing evidence that Dickens was right.

"THE LAW IS A ASS."

As someone who tries to counter the high cost of ammunition by increasing my shooting accuracy thereby decreasing the rounds needed to be fired, I have to say "warning shots" are pointless. Bang. Dead. Next question.
